US Court Orders Release of Abrego Garcia from ICE Custody
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks legal authority.
"Since his return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The case stems from a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to answer human smuggling charges, he was held in federal detention.
In her order, the judge pointed out that the authorities lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
Context of the Legal Challenge
The legal proceedings center on conflicting assertions. Whereas the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this allegation.
He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in Tennessee.
Terms of Release
The court, who was hearing his petition to removal in a federal court, determined that he must now comply with the terms of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
This decision represents a significant development in a complex legal case featuring allegations of wrongful detention and contested gang associations.
